Scope and Application

This Privacy Policy applies to all users of the BuildNectic platform, including consumers who purchase digital keepsake experiences, visitors who browse the platform without making a purchase, creators who participate in the BuildNectic Template Creator Program, and individuals who contact BuildNectic for support or general inquiries. This Policy governs all data collected through the main consumer website at buildnectic.com, the Maker personalization tool, the creator program portal, and any associated mobile-optimized or subdomain-based interfaces.

This Policy does not apply to third-party websites, services, or platforms that may be linked from BuildNectic’s platform. Such third-party services are governed by their own privacy policies, and BuildNectic is not responsible for the privacy practices or content of any third-party platforms. Users are encouraged to review the privacy policies of any third-party services they interact with in connection with their use of BuildNectic.

Information We Collect

BuildNectic collects personal information and data through several channels in the course of providing its services. The categories of information we collect are described below.

Purchase and Transaction Data: When you complete a purchase on the BuildNectic platform, we collect your email address (used to deliver the Maker link and order confirmation), your mobile phone number (used for order identification, support, and communication), the specific template or digital product purchased, the transaction amount, the payment status and method type (card, UPI, net banking, etc.), the transaction timestamp, the Order ID generated by our payment processor, and any applicable coupon or referral codes applied to the transaction. We do not collect, store, or process your actual payment instrument details (card number, CVV, UPI PIN, bank credentials). All payment processing is handled entirely by our third-party payment processor, Cashfree Payments.

Maker Tool and Personalization Data: When you use the BuildNectic Maker tool to create a personalized keepsake experience, we collect the content you submit through the Maker interface. This includes the recipient’s name, your name as the sender, your personalized message or letter text, photographs and images you upload, audio track selections or uploaded audio files, and any other personalization inputs required by the specific template you are creating.

Creator Program Data: Creators who apply for or participate in the BuildNectic Creator Program provide additional information including their full legal name, contact information, bank account or payment instrument details for commission disbursements, portfolio or prior work samples, and content submitted for template creation. This information is used exclusively for program management, identity verification, and commission processing.

Support and Communication Data: When you contact BuildNectic for support, we collect information you voluntarily provide in your communication, including your name, email address, phone number, Order ID, and a description of your inquiry or complaint. This information is retained for support tracking, quality assurance, dispute resolution, and legal compliance purposes.

Technical and Usage Data: BuildNectic may collect certain technical data automatically when you interact with the platform, including your browser type and version, operating system, device type, approximate geographic location derived from your IP address, referring URL, pages visited within the platform, time spent on pages, and other usage analytics. This data is collected in aggregated or anonymized form where possible and is used for platform optimization, security monitoring, and service improvement.

Referral and Attribution Data: If you access the BuildNectic platform through a referral link containing a creator affiliate code, campaign identifier, UTM attribution parameters, or other referral tracking identifiers, BuildNectic collects this information to attribute the visit or purchase to the applicable referral source. This data is used exclusively for creator commission calculations, affiliate program administration, fraud prevention in commission payouts, creator performance reporting, and internal marketing analytics. Referral attribution data is not sold or shared with third parties for external advertising purposes. BuildNectic maintains referral attribution records for as long as necessary to calculate, verify, and process commission obligations to participating creators.

How We Use Your Information

BuildNectic uses the information it collects strictly for the purposes of operating, maintaining, and improving the platform and fulfilling its obligations to users and creators. The specific purposes for which we use your information include: processing and fulfilling your purchase transaction; dispatching the Maker link and order confirmation to your registered email address; generating, rendering, and hosting your personalized keepsake experience; providing customer support and investigating technical issues or disputes; verifying order authenticity and preventing payment fraud; managing creator program applications, template reviews, and commission disbursements; sending service-related communications including order confirmations, Maker link delivery, technical notices, platform updates, and support responses; sending marketing communications as described in Section 11 of this Policy; conducting internal analytics to understand platform usage patterns and improve user experience; ensuring compliance with applicable laws and our contractual obligations; and fulfilling legal obligations including responding to lawful court orders, regulatory inquiries, or law enforcement requests.

BuildNectic does not use your personal information for purposes beyond those described in this Policy without your prior consent, except where required by applicable law. BuildNectic does not engage in automated decision-making or profiling that produces legal or similarly significant effects about you solely based on your personal data.

Data Sharing and Third-Party Providers

BuildNectic does not sell, rent, trade, or otherwise commercially transfer your personal information to third parties for their independent marketing or advertising purposes. We treat your personal data with strict confidentiality and share it only in the limited circumstances described below.

Payment Processors: Cashfree Payments, our payment processing partner, receives the transaction-related information necessary to process your purchase. Cashfree operates under its own privacy policy and industry-standard PCI-DSS security requirements. BuildNectic does not receive or store your payment instrument details.

Cloud Infrastructure and Hosting Providers: BuildNectic utilizes third-party cloud infrastructure, database hosting, storage services, and content delivery network (CDN) providers to operate the platform. Supabase serves as our primary database platform. These infrastructure providers may have access to data stored on their systems as required to provide their services to BuildNectic, and are bound by contractual data processing obligations consistent with industry standards.

Security and Fraud Prevention Services: BuildNectic may share information with fraud detection, identity verification, or security service providers where necessary to prevent fraudulent transactions, protect the integrity of the platform, or investigate security incidents.

Legal and Regulatory Compliance: BuildNectic may disclose personal information where required to do so by law, court order, governmental authority, or regulatory requirement; in connection with legal proceedings or to establish, exercise, or defend legal claims; or where disclosure is necessary to protect the rights, property, or safety of BuildNectic, its users, or the public.

Business Transfers: In the event of a merger, acquisition, restructuring, sale of assets, or other business combination involving BuildNectic, user data may be transferred to the acquiring or successor entity as part of the transaction. Users will be notified of such a transfer and any material changes to data practices arising from it to the extent required by applicable law.

In all cases where BuildNectic shares data with service providers or partners, it takes commercially reasonable steps to ensure that such parties implement appropriate data protection measures consistent with the standards described in this Policy.

User-Uploaded Content and Personal Data of Third Parties

BuildNectic recognizes that the content you upload through the Maker tool frequently includes personal information about third parties, including the names, photographs, and other identifying information of your intended recipients and other individuals depicted in uploaded content. Users are solely responsible for ensuring that they have obtained all necessary consents and permissions from any third parties whose personal information, photographs, or other identifying information is incorporated into a keepsake experience created through the platform.

User-uploaded photographs, messages, and personal content are treated as private by BuildNectic. We do not intentionally sell, license, or share uploaded content with any unrelated third parties. Uploaded content is processed by BuildNectic’s platform infrastructure solely for the purpose of rendering and hosting the specific keepsake experience for which it was submitted. BuildNectic does not use uploaded photographs, messages, keepsake content, audio files, creator submissions, or any uploaded media for artificial intelligence model training, machine learning dataset construction, public datasets, resale datasets, or any commercial AI training purposes of any kind, without the user’s explicit prior consent. This prohibition applies regardless of whether such content is processed directly by BuildNectic or by any third-party service provider engaged by BuildNectic. BuildNectic makes no claim to use user-created emotional or personal content for any purpose other than delivering the service directly requested by the user.

If you believe that your personal information has been uploaded to a BuildNectic keepsake experience without your consent by another user, please contact BuildNectic through the official Telegram support channel with relevant details. BuildNectic will investigate such reports and take appropriate action in accordance with its content policies and applicable law.

Cookies, Local Storage, and Tracking Technologies

BuildNectic uses browser-based local storage on the main consumer website to store certain user preferences and previously entered information — specifically, your email address and phone number — to provide an autofill convenience for repeat visitors on the same device and browser. This local storage is stored entirely on your device and is not transmitted to external tracking networks or advertising platforms. You can clear this stored information at any time by clearing your browser’s site data or local storage for the buildnectic.com domain.

BuildNectic may use essential session cookies or similar technologies necessary for the technical operation of the platform, such as maintaining session continuity during the Maker tool workflow. These technical cookies do not track your activity across unrelated websites and are not used for cross-site behavioral advertising.

BuildNectic does not currently deploy third-party advertising trackers, retargeting pixels, social media pixels, or behavioral advertising technologies on its platform. If this practice changes in the future, this Policy will be updated accordingly and users will be notified. Standard web analytics tools may be used in anonymized form to understand aggregate platform usage patterns, and such analytics do not constitute personal data processing in individually identifiable form.

Keepsake Link Privacy and Sharing

A keepsake experience link is a unique URL generated by the BuildNectic platform after a personalized experience is created through the Maker tool. The keepsake link is intended to be shared by the purchaser with the intended recipient. BuildNectic does not control who receives or views a keepsake link once it has been shared by the user. Users are solely responsible for the decision to share their keepsake link and for the channels through which they choose to share it.

If a user voluntarily shares a keepsake link — whether directly with the intended recipient, on social media, in group messaging applications, or through any other medium — BuildNectic is not responsible for who accesses the link as a result of that sharing decision, nor for any consequences arising from unintended individuals viewing the keepsake experience. Users who are concerned about the privacy of their keepsake content are advised to share the link only through secure, direct channels with the specific intended recipient.

BuildNectic uses commercially reasonable technical security measures to protect the keepsake link infrastructure from unauthorized access. However, because keepsake links are designed to be shareable and viewable without authentication by the recipient, BuildNectic cannot prevent unauthorized viewing if a link is shared beyond the intended recipient by any person who receives it.

Data Retention and Deletion

BuildNectic retains personal data for as long as necessary to fulfill the purposes for which it was collected, to provide ongoing services to users, and to comply with applicable legal, tax, and regulatory obligations. The general data retention principles applicable to different categories of data are as follows.

Purchase and transaction data, including email addresses, phone numbers, order metadata, and payment records, are retained for a minimum period necessary to comply with applicable financial recordkeeping and tax laws, and for a reasonable period thereafter to support dispute resolution, fraud prevention, and audit purposes. Creator program data is retained for the duration of the creator relationship and for a reasonable period following termination to address potential commission disputes or legal claims.

User-uploaded content including photographs, messages, and personalization data associated with a keepsake experience are retained for the estimated operational hosting window applicable to the experience, subject to the temporary hosting policies described in the Terms of Service. BuildNectic expressly reserves the right to archive, compress, optimize, migrate, or permanently delete content from active systems when hosting periods expire, when services are discontinued, when infrastructure changes occur, or where operational, legal, security, or compliance reasons require removal. Users should not expect BuildNectic to retain a permanent or indefinite copy of uploaded content. Users are solely responsible for maintaining their own copies of any content they upload to the platform if they wish to preserve that content beyond the estimated hosting window.

If you wish to request the deletion of your personal data from BuildNectic’s records, please contact BuildNectic through the official Telegram support channel with your full name, registered email address, and order details. BuildNectic will process deletion requests in accordance with applicable law, which may permit retention of certain data for legal, compliance, or fraud prevention purposes even following a deletion request. Deletion requests will be responded to within a reasonable timeframe and in any event within any period mandated by applicable privacy law.

Security Measures

BuildNectic implements commercially reasonable technical, administrative, and physical security measures designed to protect your personal data from unauthorized access, disclosure, alteration, destruction, or misuse. These measures include HTTPS encryption for all data transmitted between your device and the BuildNectic platform, database-level access controls restricting data access to authorized personnel, secure cloud infrastructure with industry-standard security certifications, regular security assessments of platform systems, and internal access control policies limiting data access on a need-to-know basis.

Payment processing is handled through Cashfree Payments using bank-grade SSL encryption and PCI-DSS compliant infrastructure. BuildNectic does not have access to your complete payment instrument details, and such details are never stored on BuildNectic’s servers.

Notwithstanding the above, users acknowledge and accept that no internet-based system, digital platform, cloud infrastructure, or electronic communication can be guaranteed to be one hundred percent (100%) secure against all possible threats. BuildNectic uses commercially reasonable security measures but cannot guarantee absolute security of internet-based systems, cloud infrastructure, or electronic communications of any kind. BuildNectic is not liable for data breaches or security incidents arising from circumstances beyond its reasonable control, including sophisticated cyberattacks, zero-day vulnerabilities, or failures in third-party infrastructure providers. In the event of a data breach that creates a risk to users’ rights and freedoms, BuildNectic will take prompt remedial action and provide required notifications in accordance with applicable law.

Your Privacy Rights

Depending on your jurisdiction of residence, you may have certain rights with respect to your personal data under applicable privacy law. These rights may include: the right to know what personal data BuildNectic holds about you; the right to request a copy of your personal data in a portable format; the right to request correction or updating of inaccurate or incomplete personal data; the right to request deletion of your personal data, subject to legal retention requirements; and the right to withdraw consent to processing where processing is based on consent.

To exercise any of these rights, please contact BuildNectic through the official Telegram support channel, clearly stating the nature of your request and providing sufficient information to identify your account and the data subject to your request. BuildNectic will respond to your request within a reasonable timeframe and in any event within any period mandated by applicable privacy law. BuildNectic may need to verify your identity before processing your request to ensure the security and integrity of user data.

Please note that certain privacy rights are subject to limitations under applicable law. For example, data that must be retained for legal compliance, audit, fraud prevention, or dispute resolution purposes cannot be deleted pursuant to a deletion request, notwithstanding your right to deletion under other circumstances.

Marketing Communications and Opt-Out

BuildNectic may send marketing, promotional, or informational communications to users who have provided their email address in connection with a purchase or registration on the platform. These communications may include new template announcements, seasonal promotional campaigns, creator program updates, feature release notifications, platform improvement announcements, partnership promotions, and related commercial content.

Where required by applicable law, marketing communications will include a clear and functional unsubscribe mechanism. Users may opt out of receiving marketing emails by clicking the unsubscribe link included in any marketing email or by contacting BuildNectic through the official Telegram support channel with an explicit opt-out request. BuildNectic will process opt-out requests promptly, typically within ten (10) business days. Please note that opting out of marketing communications will not affect transactional and service-related communications that are essential to the delivery of a purchased service, such as order confirmations and Maker link deliveries.

Children's Privacy

The BuildNectic platform is not directed at or intended for use by individuals under the age of eighteen (18) years, and BuildNectic does not knowingly collect personal information from individuals under this age. If you are a parent or guardian and believe that your child under the age of eighteen (18) has provided personal information to BuildNectic without your consent, please contact BuildNectic immediately through the official Telegram support channel. Upon receiving such a notification and verifying its validity, BuildNectic will take prompt steps to delete the relevant personal information from its records.

Third-Party Links and Integrations

The BuildNectic platform may contain links to third-party websites, services, social media platforms, or external resources for the convenience and information of users. BuildNectic does not endorse, control, or take responsibility for the privacy practices, content, or security of any third-party websites or services. The inclusion of a link on the BuildNectic platform does not imply endorsement or affiliation. Users who follow links to third-party platforms are advised to review the privacy policies of those platforms independently. BuildNectic is not liable for any privacy violations, data breaches, or other incidents that occur on third-party platforms.

Cross-Border Data Transfers

BuildNectic operates in India and its primary data processing and storage infrastructure is located in India. However, BuildNectic may use cloud infrastructure providers whose servers are located in multiple jurisdictions globally, including but not limited to the United States, European Union, and Asia-Pacific regions. By using the BuildNectic platform, you consent to the transfer of your personal data to servers and infrastructure located outside your jurisdiction of residence, provided that BuildNectic takes commercially reasonable steps to ensure that such transfers are subject to appropriate contractual safeguards consistent with applicable data protection law.

Changes to This Privacy Policy

BuildNectic reserves the right to modify, update, or replace this Privacy Policy at any time to reflect changes in platform features, data practices, legal requirements, or regulatory guidance. The date of the most recent revision will be indicated at the top of this Policy. BuildNectic may notify users of material changes to this Policy via email or prominent notice on the platform. Your continued use of the BuildNectic platform following the posting of revised Policy terms constitutes your acceptance of those changes. Users who do not agree with a revised Privacy Policy should discontinue use of the platform and may submit a data deletion request as described in Section 8.
