About BuildNectic and Our Services

BuildNectic Keepsake Studio (“BuildNectic”) is a digital experience platform that enables individuals to create, personalize, and share interactive digital keepsake experiences, personalized greeting templates, surprise pages, celebration experiences, memory pages, proposal experiences, anniversary tributes, farewell keepsakes, apology experiences, confession pages, and creator-generated digital emotional templates. Our platform provides purchasers with access to a proprietary web-based Maker tool through which personalized content — including uploaded photographs, custom messages, audio preferences, and recipient details — is embedded into a richly animated, dynamically rendered web experience that can be shared with recipients via a unique hyperlink.

BuildNectic operates as a technology platform and digital content marketplace. We are not a greeting card printing service, physical product retailer, event planning company, counseling service, or relationship advisory service. All products and services provided by BuildNectic are digital in nature and are delivered electronically through the internet. BuildNectic reserves the right to add, modify, discontinue, suspend, or restructure any of its products, features, templates, tools, or services at any time and in its sole discretion, with or without prior notice to users.

The BuildNectic platform includes, but is not limited to, the main consumer website at buildnectic.com, the template maker portal, the creator program portal, the administrative panel, and any mobile-optimized or subdomain-based interfaces operated under the BuildNectic brand. All such properties are subject to these Terms.

Eligibility and Access

To use the BuildNectic platform and purchase digital products or experiences, you must be at least eighteen (18) years of age or the age of majority in your jurisdiction of residence, whichever is greater. If you are under the applicable age of majority, you may only use the platform with the active supervision and consent of a parent or legally recognized guardian who agrees to be bound by these Terms on your behalf. By using the platform, you represent and warrant that you meet the applicable age requirement or have such parental or guardian consent.

You agree to provide accurate, truthful, current, and complete information when making purchases, registering for services, or submitting content through the BuildNectic platform. You further agree that you will not use the platform in any manner that violates applicable local, national, or international laws or regulations, and that you are solely responsible for ensuring your use of the platform complies with all laws applicable in your jurisdiction. BuildNectic reserves the right to refuse service, suspend access, or terminate accounts at any time for any reason, including suspected violation of these Terms or applicable law.

Purchases, Pricing, and Payment

BuildNectic offers digital products and experiences for purchase through the platform. All prices displayed are in Indian Rupees (INR) unless otherwise expressly stated, and are inclusive of applicable taxes where required by law. Payments are processed through Cashfree Payments, a third-party payment processor, and BuildNectic does not directly collect, store, or process any credit card, debit card, UPI, net banking, or other payment instrument information. All payment data is governed by the privacy and security policies of the applicable payment processor.

Upon successful payment, the purchaser will receive a unique Maker link delivered to the email address provided at the time of purchase, along with an order confirmation. This Maker link grants one-time access to the personalization tool for the purchased template. The service is considered delivered and fulfilled at the moment the Maker link is dispatched to the purchaser’s registered email address. Each Maker link is single-use; once a personalized experience is submitted through the Maker tool, the link is permanently deactivated and cannot be reused. Purchasers requiring additional experiences must complete separate purchases.

BuildNectic processes all transactions in good faith and takes commercially reasonable steps to ensure accurate order fulfillment. However, in the event of technical failures, payment processor errors, or circumstances outside BuildNectic’s control, BuildNectic’s sole obligation is to investigate the issue and, at its sole discretion, re-dispatch the applicable Maker link or provide an equivalent remedy. Such remediation shall not be construed as creating an obligation to issue a monetary refund under any circumstances.

Pricing Changes and Modification Policy

BuildNectic expressly reserves the right to change, modify, increase, decrease, or restructure the pricing of any template, product, or service available on the platform at any time and without prior notice. Pricing decisions are made at BuildNectic’s sole discretion and may reflect changes in production costs, market conditions, demand patterns, promotional strategies, business model evolution, creator program structures, or platform-wide pricing initiatives.

A template or digital experience that is offered at no cost today may, at any future date, become a paid product. Conversely, a template that currently carries a purchase price may become available at no cost in the future. In either case, users who have previously purchased a now-free template are not entitled to any refund, credit, or compensation on the basis of a subsequent price reduction. Similarly, users who accessed a previously free template are not entitled to continued free access if that template is subsequently made available only as a paid product without a grandfathering arrangement.

All previously completed and paid orders are governed exclusively by the pricing applicable at the precise time of that purchase transaction. Price changes — whether upward or downward — occurring after the moment of a completed transaction do not retroactively affect that transaction and do not create any right to a price adjustment, partial refund, credit note, or any form of compensation. By making a purchase, you acknowledge and accept that you have reviewed the pricing at the time of transaction and that the transaction is final on those terms.

No Refund, No Cancellation Policy

ALL PURCHASES MADE ON THE BUILDNECTIC PLATFORM ARE FINAL AND NON-REFUNDABLE. BuildNectic operates an absolute no-refund policy with respect to all digital products, keepsake experiences, templates, and services offered on the platform. This policy applies universally and without exception, regardless of the circumstances of the request.

The rationale for this policy is rooted in the nature of digital goods: at the moment payment is successfully completed and a Maker link is dispatched to the purchaser’s registered email address, the digital service has been delivered in full. Unlike physical goods, digital products cannot be “returned” in any meaningful sense because the purchaser has received access to the product and has benefited from the transaction. The personalized and on-demand nature of BuildNectic’s keepsake experiences further reinforces this policy, as the platform infrastructure, creator resources, and delivery systems are engaged upon each purchase.

No refund will be issued under any circumstances, including but not limited to: dissatisfaction with the template design, visual style, animation quality, or content of any experience; failure to use the Maker link after purchase; expiry or deactivation of a Maker link due to non-use; entry of an incorrect or invalid email address at checkout resulting in non-receipt of the Maker link; change of mind after the transaction is completed; inability to access the platform due to device incompatibility, network issues, or browser limitations; the recipient’s failure to open or view the shared keepsake link; dissatisfaction with the emotional impact, visual quality, or content of the personalized experience created by the user; template pricing changes occurring after the time of purchase; subsequent availability of the same template at a lower price or at no cost; or any other subjective reason for dissatisfaction.

BuildNectic further maintains a strict anti-chargeback policy. Initiating a chargeback, payment dispute, or reversal with your bank, card network, or payment service provider without first exhausting the dispute resolution process described in these Terms is a violation of this Agreement. BuildNectic maintains comprehensive records of all transactions, order fulfillments, Maker link dispatches, and platform access logs. In the event of an unjustified chargeback or fraudulent dispute, BuildNectic will contest such dispute using all available evidence and reserves the right to permanently suspend or terminate the relevant account, flag the email and phone number associated with the transaction, and pursue all available legal remedies. Fraudulent chargebacks may also be reported to applicable payment networks, fraud prevention databases, and regulatory authorities as permitted by law.

Cancellation requests submitted after a transaction has been processed will not be honored. Orders cannot be cancelled, paused, transferred, or modified once payment has been completed. If you believe you have identified a genuine technical error or platform-side failure (such as payment being successfully charged but the Maker link never being dispatched), you must contact BuildNectic support via official Telegram support or email within forty-eight (48) hours of the transaction, providing your Order ID, registered email address, registered phone number, and a detailed description of the issue. BuildNectic will investigate in good faith and may, at its sole discretion, re-dispatch the Maker link or provide technical assistance. Such investigation and resolution do not constitute admission of any refund obligation.

Keepsake Link Hosting and Availability

Upon successful completion of the personalization process through the BuildNectic Maker tool, a unique keepsake experience link is generated and made accessible for sharing with the intended recipient. BuildNectic is designed and intended to function as a temporary digital gifting and surprise platform, not as a permanent cloud storage service, long-term content archive, or perpetual digital hosting solution of any kind. Users should understand from the outset that all keepsake experiences created through the platform are inherently temporary in nature.

For paid keepsake experiences, BuildNectic currently provides an estimated availability window of up to eight (8) days from the date of creation of the keepsake experience. This stated window is an estimated operational parameter only and is not a guarantee, warranty, contractual commitment, service level agreement, or legally enforceable promise of any kind. A keepsake experience may remain accessible beyond eight days depending on platform conditions at the time. Equally, a keepsake experience may become inaccessible before the expiration of this estimated window due to any of the following: changes in hosting infrastructure, technology, or platform architecture; scheduled or emergency maintenance; migration to new technical systems or databases; force majeure events as described in Section 17; storage system failures, data corruption, or server infrastructure failures; changes in applicable laws, court orders, or regulatory requirements mandating removal or restriction of content; business restructuring, merger, acquisition, dissolution, cessation of operations, or assignment to a successor entity; third-party infrastructure failures beyond BuildNectic’s reasonable control; security incidents requiring content takedowns; or any other operational or legal circumstances.

BuildNectic does not guarantee uninterrupted, error-free, or access to any keepsake link for any specific period of time. Users are strongly advised to screenshot, screen-record, download, or otherwise independently preserve any keepsake content they wish to retain permanently. BuildNectic does not offer backup, export, or archival services for user-created content. No refund, credit, compensation, or extension shall be due to any user as a result of the expiration, removal, deletion, suspension, degradation, or inaccessibility of a keepsake experience, regardless of the cause and regardless of whether the estimated availability window has been fully elapsed.

BuildNectic reserves the right to archive, compress, migrate, reformat, or permanently delete content from active systems when the estimated hosting window expires, when services are discontinued, when infrastructure changes occur, or where operational, legal, security, or compliance reasons require removal. Users understand that the visual rendering, interactive features, or media quality of keepsake experiences may degrade or become inaccessible due to browser evolution, technology changes, or infrastructure updates at any time, and that such changes do not constitute a service failure or entitle users to any remedy.

Free Content and Free Experience Policy

BuildNectic may, from time to time, offer certain templates, keepsake experiences, or digital products at no charge (“Free Content”). Access to Free Content is provided entirely at BuildNectic’s discretion as a promotional, goodwill, or business development initiative, and no contractual obligation of continued access is created by the current availability of any Free Content. Free Content should never be relied upon as a persistent or guaranteed service offering.

Free Content receives absolutely no guaranteed hosting duration of any kind. BuildNectic expressly reserves the right, at any time and without prior notice, to remove, archive, suspend, restrict, modify, degrade, discontinue, or permanently delete any Free Content and any keepsake links or experiences generated using Free Content. Users who have created experiences using Free Content acknowledge that those experiences may become inaccessible at any time, immediately, and without notice, and without any entitlement to a remedy, compensation, credit, extension, or substitute service of any kind.

BuildNectic may convert Free Content to paid status at any time without notice. Users who created an experience using a template while it was offered for free will not be entitled to ongoing free access if that template or the infrastructure supporting the experience is subsequently restructured under a paid model. Free access must never be presumed to continue. Users who believe the content they are creating has significant sentimental or personal value are strongly advised to screenshot, screen-record, or otherwise preserve a copy of the experience independently of the platform, as BuildNectic provides no backup or export functionality and cannot guarantee future access to free-tier experiences.

User-Generated Content and Content Responsibility

BuildNectic operates as a technology platform and passive content host. When users create personalized keepsake experiences, they upload and incorporate a variety of content including but not limited to photographs, video clips, audio files, written messages, names, dates, email addresses, and other personal and sentimental information (“User-Generated Content” or “UGC”). Users are solely and exclusively responsible for all User-Generated Content they submit, upload, publish, or transmit through the BuildNectic platform.

By uploading or submitting User-Generated Content through the platform, you represent and warrant that: (a) you are the original creator of the content or have obtained all necessary rights, licenses, consents, and permissions to use, upload, and distribute the content through the BuildNectic platform; (b) your content does not infringe, misappropriate, or violate any third party’s intellectual property rights, privacy rights, moral rights, publicity rights, or any other proprietary rights; (c) your content does not contain any material that is defamatory, libelous, obscene, sexually explicit, hateful, harassing, threatening, or otherwise objectionable under applicable law; (d) your content does not contain false, misleading, or fraudulent information about any person, entity, or event; (e) you have obtained the express consent of all identifiable individuals depicted in photographs or videos you upload, particularly where those individuals are third parties; and (f) the submission and use of your content as contemplated by the platform complies with all applicable laws in your jurisdiction.

BuildNectic does not review, screen, moderate, or approve User-Generated Content before it is published or incorporated into a keepsake experience. BuildNectic acts solely as a passive conduit and technical host for User-Generated Content and has no editorial responsibility for the content users create. BuildNectic is not responsible for, and expressly disclaims all liability arising from: the meaning, intent, emotional impact, interpretation, accuracy, or consequences of any User-Generated Content; disputes arising between users and their intended recipients regarding the content of a keepsake experience; relationship disputes, family disputes, romantic disputes, marriage disputes, friendship disputes, breakup consequences, or any interpersonal conflicts that arise as a result of a keepsake experience being shared, received, or viewed; emotional distress, psychological harm, mental health consequences, reputational harm, social consequences, or personal suffering of any kind arising from the nature or content of a keepsake experience created or shared through the platform; misunderstandings or misinterpretations of the content, tone, or intent of a user-created experience by the recipient; the manner in which a recipient reacts, responds, or does not respond to a keepsake experience; privacy claims from third parties whose images, names, or personal information were uploaded without their knowledge or consent; copyright or intellectual property claims from rights holders whose content was used without authorization; or any other legal, civil, or criminal claims arising from the nature, content, or distribution of User-Generated Content created through the platform. BuildNectic is not a relationship advisor, emotional support service, or counseling platform, and the Company bears absolutely no responsibility for emotional reactions, relationship outcomes, family outcomes, social consequences, or personal conflicts of any nature arising from experiences created and shared by users on the platform.

You agree to indemnify, defend, and hold harmless BuildNectic, its officers, directors, employees, contractors, and agents from and against all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to your User-Generated Content, your use of the platform, your violation of these Terms, or your violation of any third party’s rights. BuildNectic reserves the right, but assumes no obligation, to remove any User-Generated Content that it determines, in its sole discretion, violates these Terms, applicable law, or third-party rights.

Intellectual Property Rights

All original content, design elements, animations, software, source code, platform architecture, template frameworks, interactive experiences, canvas rendering systems, particle physics engines, audio player systems, user interface designs, graphic assets, branding, trademarks, service marks, trade names, domain names, and all other intellectual property embodied in or associated with the BuildNectic platform are the exclusive property of BuildNectic or its licensors, and are protected by applicable intellectual property laws including copyright, trademark, and patent law. Nothing in these Terms transfers any intellectual property rights to you.

Upon completing a purchase, BuildNectic grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the purchased keepsake experience template solely for personal, non-commercial purposes. This license does not permit: copying, reproducing, distributing, republishing, or downloading any portion of the platform or its proprietary technology; reverse engineering, decompiling, disassembling, or attempting to extract source code from any part of the platform; using BuildNectic’s templates, animations, or experience frameworks to create competing products or services; reselling, sublicensing, or commercializing BuildNectic templates or experiences; or removing, altering, or obscuring any copyright, trademark, or other proprietary notices.

With respect to User-Generated Content, you retain ownership of the content you create and upload. By submitting User-Generated Content to the platform, you grant BuildNectic a limited, worldwide, royalty-free, non-exclusive license to store, process, display, and transmit your content solely as necessary to operate the platform and render the keepsake experience you have created. BuildNectic does not claim ownership of your User-Generated Content and will not use it for marketing, promotional, or commercial purposes without your express prior consent, except as described in the Privacy Policy.

Acceptable Use and Prohibited Conduct

Your use of the BuildNectic platform is subject to strict acceptable use requirements. You agree that you will not use the platform for any purpose that is unlawful, harmful, abusive, defamatory, or otherwise violates these Terms or applicable law. The following categories of conduct are expressly prohibited and constitute material breaches of this Agreement.

The following categories of content are strictly and absolutely prohibited on the BuildNectic platform, regardless of the purpose or intent of the upload: (a) pornographic content, adult sexual content, sexually explicit material, obscene depictions, fetish content, or content of a prurient sexual nature in any form; (b) escort service advertisements, adult industry solicitations, or content promoting commercial sexual services; (c) child sexual abuse material (CSAM) or any depiction of minors in a sexual, suggestive, or exploitative context — any such content will be immediately reported to law enforcement and relevant authorities; (d) non-consensual intimate images, revenge pornography, or any sexually explicit depictions of real individuals published without their express verified consent; (e) content designed to harass, intimidate, stalk, threaten, bully, or cause psychological harm to a specific individual or group; (f) hate speech targeting individuals or groups based on race, ethnicity, religion, gender identity, sexual orientation, disability, caste, or national origin; (g) content that promotes, glorifies, or incites acts of violence, terrorism, self-harm, or criminal activity; or (h) content that facilitates fraud, identity theft, phishing, impersonation, or financial crime.

You must not engage in conduct that: attempts to gain unauthorized access to any portion of the BuildNectic platform, administrative systems, other users’ accounts, or underlying infrastructure; interferes with, disrupts, or impairs the integrity, performance, or availability of the platform, its servers, or connected networks; uses automated bots, scrapers, crawlers, or scripts to access, extract, or interact with the platform in an unauthorized manner; creates false or fraudulent orders, payment disputes, or support requests; attempts to circumvent security measures, access controls, or payment systems; resells, redistributes, or commercializes BuildNectic products or Maker links without express written authorization; or otherwise acts in a manner that could expose BuildNectic to legal liability or reputational harm.

BuildNectic reserves the right to investigate and take appropriate action against any user suspected of violating this Acceptable Use Policy, including immediate termination of access, permanent account suspension, removal of content, reporting to law enforcement authorities, and pursuing civil legal remedies including injunctive relief and damages.

Email Delivery and Platform Communication

Following a successful purchase, BuildNectic will dispatch the Maker link and order confirmation to the email address provided by the purchaser at the time of checkout. The accuracy of the email address provided is entirely and exclusively the responsibility of the purchaser. BuildNectic has no mechanism to verify whether an email address provided at checkout is valid, active, or controlled by the person making the purchase prior to dispatching communications.

If a Maker link or order confirmation is not received because the purchaser entered an incorrect, misspelled, inactive, or non-existent email address, BuildNectic bears absolutely no responsibility for such non-delivery and no refund shall be issued as a consequence. If a purchaser believes that a Maker link was not delivered despite having provided a correct and active email address, the purchaser must first check their spam, junk, promotions, and other filtered folders in their email client before contacting support. Many email service providers route transactional emails to non-primary folders by default.

If, following a thorough check of all email folders, a purchaser still believes the Maker link was not delivered, the purchaser must contact BuildNectic through the official Telegram support channel, which is the primary and preferred support channel for all BuildNectic customer inquiries. The purchaser must provide their Order ID, full name, registered phone number, and the email address entered at checkout. BuildNectic will make commercially reasonable efforts to investigate such reports and respond within forty-eight (48) hours of receipt of the complete information required, though response times may vary based on volume and operational circumstances and are not guaranteed. This support commitment applies to genuine technical delivery failures and does not create any obligation to issue refunds or compensate for issues attributable to the purchaser’s own error.

Template Creator Program

BuildNectic operates a creator program through which approved individuals (“Creators”) may design and submit original template experiences for listing on the BuildNectic platform. Creators who participate in the program remain solely and entirely responsible for all content they design, submit, publish, or distribute through the BuildNectic creator program. Creators represent and warrant that their submitted templates do not infringe any third-party intellectual property rights, contain no unlawful content, comply with BuildNectic’s content guidelines, and accurately represent the nature and quality of the experience they provide.

BuildNectic reserves the right, in its sole and absolute discretion, to review, approve, reject, modify, remove, suspend, disable, delist, or permanently discontinue any creator-submitted template at any time and without prior notice or stated reason. Removal of a creator’s template does not entitle the creator to any compensation, damages, or remedy unless specifically provided for in a separately executed creator agreement. BuildNectic’s decision regarding template approval or rejection is final.

BuildNectic may, at any time, modify the creator program’s commission structure, payout percentages, eligibility requirements, content review processes, payout schedules, minimum payout thresholds, payment methods, performance criteria, or any other aspect of the creator program terms. Such modifications may be made with or without prior notice, except where legally required. Continued participation in the creator program following notification of changes constitutes acceptance of the modified terms. Creators who disagree with modifications to the creator program terms may terminate their participation by notifying BuildNectic in writing, provided that accrued but unpaid commissions will be processed according to the standard payout schedule applicable at the time of termination.

BuildNectic is not liable for any claims by third parties arising from creator-submitted content. Creators agree to indemnify and hold harmless BuildNectic from all third-party claims, damages, and legal costs arising from their submitted content.

Platform Rights and Modifications

BuildNectic reserves the right to modify, enhance, redesign, restructure, deprecate, or discontinue any feature, tool, template, product, service, workflow, or functionality available on the platform at any time. This includes, but is not limited to, changes to the Maker tool interface, the template library, the animation engine, audio player functionality, photo upload capabilities, keepsake link delivery mechanisms, and the creator program portal. Such changes may be implemented immediately or following a notice period at BuildNectic’s discretion.

BuildNectic further reserves the right to temporarily or permanently suspend access to the platform for scheduled or emergency maintenance, infrastructure upgrades, security patching, compliance remediation, or any other operational reason. BuildNectic will make commercially reasonable efforts to minimize service disruptions and, where feasible, provide advance notice of planned maintenance. However, BuildNectic does not warrant any specific level of platform uptime or availability, and temporary unavailability does not entitle users to refunds or compensation.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUILDNECTIC, ITS PARENT COMPANY, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS; LOSS OF REVENUE; LOSS OF DATA OR INFORMATION; BUSINESS INTERRUPTION; LOSS OF GOODWILL; LOSS OF OPPORTUNITY; COST OF SUBSTITUTE SERVICES; EMOTIONAL DISTRESS OR PSYCHOLOGICAL HARM ARISING FROM USER-CREATED CONTENT OR SHARED KEEPSAKE EXPERIENCES; RELATIONSHIP HARM OR INTERPERSONAL CONSEQUENCES ARISING FROM A KEEPSAKE EXPERIENCE; DAMAGE ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT; OR ANY OTHER INDIRECT OR CONSEQUENTIAL LOSS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF BUILDNECTIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUILDNECTIC’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO BUILDNECTIC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR 500 (FIVE HUNDRED INDIAN RUPEES), WHICHEVER IS GREATER. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE, INCLUDING WITHOUT LIMITATION BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION, AND ANY OTHER TORT.

Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such jurisdictions, the above limitations shall apply to the maximum extent permitted by applicable law, and certain exclusions may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or fraudulent misrepresentation.

Disclaimer of Warranties

THE BUILDNECTIC PLATFORM AND ALL PRODUCTS, SERVICES, TEMPLATES, KEEPSAKE EXPERIENCES, AND CONTENT PROVIDED THROUGH IT ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUILDNECTIC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT; WARRANTIES THAT THE PLATFORM WILL OPERATE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS; WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT OR INFORMATION ON THE PLATFORM; AND WARRANTIES THAT DEFECTS IN THE PLATFORM WILL BE CORRECTED.

BuildNectic does not warrant that keepsake experiences will display correctly on all devices, browsers, screen sizes, or network environments. Certain interactive features, animations, audio capabilities, or visual effects may not function as intended on all platforms, and this does not constitute a defect entitling the purchaser to a remedy. Users are advised to test platform compatibility before relying on the platform for a specific occasion.

Indemnification

You agree to defend, indemnify, and hold harmless BuildNectic and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to: your violation of these Terms; your User-Generated Content or use of the platform in violation of applicable law; your violation of any third party’s rights, including intellectual property rights, privacy rights, or rights of publicity; any dispute between you and a recipient of a keepsake experience you created; your use of the platform for any purpose prohibited by these Terms; or any misrepresentation made by you in connection with the platform. BuildNectic reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, in which case you agree to cooperate fully with BuildNectic in asserting any available defenses.

Force Majeure

BuildNectic shall not be liable for any delay, failure, disruption, unavailability, or interruption of service arising from circumstances beyond its reasonable control, including but not limited to: natural disasters (including earthquakes, floods, fires, hurricanes, cyclones, and other extreme weather events); acts of war, terrorism, civil unrest, or government-imposed restrictions; pandemics, epidemics, or public health emergencies declared by governmental or international health authorities; power failures, telecommunications infrastructure outages, or internet service disruptions; cyberattacks, distributed denial-of-service (DDoS) attacks, or data breaches affecting hosting infrastructure; actions or failures of third-party service providers, including hosting providers, payment processors, cloud infrastructure providers, or content delivery networks; government-mandated shutdowns, legal orders, or regulatory interventions; or any other event or circumstance that is outside the reasonable anticipation and control of BuildNectic.

In the event of a force majeure event, BuildNectic’s obligations under these Terms shall be suspended for the duration of the event and for a reasonable period thereafter to allow for recovery and normalization of operations. BuildNectic will make commercially reasonable efforts to restore service as promptly as practicable following the cessation of the force majeure event. No refund, credit, or compensation shall be due to any user as a result of service disruption caused by a force majeure event.

Governing Law and Dispute Resolution

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or your use of the BuildNectic platform shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the courts of competent jurisdiction located in Rajasthan, India, and you irrevocably consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceeding, you agree to first contact BuildNectic through the official Telegram support channel, describing the nature of your dispute in detail and specifying the remedy you seek. Both parties agree to negotiate in good faith for a period of thirty (30) days following receipt of such notice before commencing formal legal proceedings. This informal dispute resolution requirement does not apply to claims seeking emergency injunctive or other equitable relief.

Any claim arising under these Terms must be brought within one (1) year of the date on which the cause of action accrues, after which such claim is permanently barred. This limitation applies regardless of any statute of limitations to the contrary under applicable law, to the maximum extent permitted.

Termination of Access

BuildNectic reserves the right, in its sole and absolute discretion, to suspend, restrict, or permanently terminate your access to the platform, any order, any Maker link, or any keepsake experience at any time, with or without prior notice, and without liability to you, if BuildNectic reasonably believes that you have: violated any provision of these Terms; engaged in fraudulent, abusive, or illegal conduct in connection with the platform; submitted User-Generated Content that violates applicable law or third-party rights; initiated an unauthorized chargeback or payment dispute; impersonated another person or entity; engaged in conduct that could damage the reputation, operations, or legal standing of BuildNectic; or otherwise acted in a manner incompatible with the continued provision of services.

Termination does not relieve you of any obligations or liabilities incurred prior to termination, and all provisions of these Terms that by their nature should survive termination (including intellectual property, indemnification, limitation of liability, and dispute resolution provisions) shall survive and remain in full force and effect.

Support and Customer Assistance

BuildNectic provides customer support for genuine technical issues related to the platform. The primary and official support channel is the BuildNectic Telegram support account. Telegram is the preferred method of contact for all support requests, technical issues, order inquiries, and dispute notifications. BuildNectic targets a support response time of within forty-eight (48) hours of receiving a complete support request, though actual response times may vary based on support volume, complexity of the issue, operational capacity, time zones, and other factors. This target response time is a good-faith operational guideline and is not a legally enforceable service level agreement or guarantee of response within any specific timeframe.

Support requests must include all relevant details including the Order ID, registered email address, registered phone number, and a clear description of the issue being reported. Incomplete support requests may delay the investigation process significantly. BuildNectic’s support team will make commercially reasonable efforts to resolve genuine technical issues but is not obligated to provide support for issues arising from user error, device incompatibility, network limitations, incorrect information provided at checkout, or circumstances outside BuildNectic’s reasonable control.

Marketing Communications

By providing your email address and phone number in connection with a purchase or registration on the BuildNectic platform, you acknowledge that BuildNectic may send you service-related notifications, order confirmations, Maker link deliveries, platform update announcements, feature release notifications, creator program updates, promotional campaigns, partnership announcements, and other marketing or commercial communications related to BuildNectic’s products and services.

Where required by applicable law, BuildNectic will provide you with a mechanism to unsubscribe from marketing communications. You may opt out of marketing emails by following the unsubscribe link included in such emails or by contacting BuildNectic at admin@buildnectic.com. Please note that opting out of marketing communications will not affect transactional communications necessary for service delivery, such as order confirmations and Maker link deliveries, which are essential to the fulfillment of your purchase.

Severability and Entire Agreement

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if it cannot be so modified, it shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision.

These Terms, together with BuildNectic’s Privacy Policy and Refund Policy (both of which are incorporated herein by reference), constitute the entire agreement between you and BuildNectic with respect to your use of the platform and supersede all prior agreements, understandings, representations, and warranties, whether oral or written, relating to the subject matter hereof. No waiver by BuildNectic of any breach or default shall be deemed a waiver of any subsequent breach or default, and shall not affect the other terms of this Agreement.

Modifications to These Terms

BuildNectic reserves the right to revise, update, or replace these Terms at any time at its sole discretion. Changes will be effective immediately upon posting the revised Terms on the platform, unless a different effective date is specified. The date of the most recent revision will be indicated at the top of this page. BuildNectic may, but is not obligated to, provide notice of material changes via email or prominent platform notification. Your continued use of the BuildNectic platform following the posting of revised Terms constitutes your binding acceptance of those changes. If you do not agree to the revised Terms, your sole remedy is to discontinue use of the platform.
